  26. AGREEMENT

    I hereby acknowledge that I am the bona fide and actual grower/producer of the above-listed produce and/or goods that I intend to sell at the 2026 Downtown Westminster Farmers’ Market and said produce and/or goods are grown or produced at the specified business location listed on this application. I also attest that I have read and understand the 2026 Downtown Westminster Farmers’ Market Rules and Regulations, revised, and updated in December 2025, this Application/Contract and the Release and Indemnification Form and that I agree to abide by them. I acknowledge the admission to the Downtown Westminster Farmers’ Market and market space assignments are made at the discretion of the market management. I agree that failure to comply with the Rules and Regulations, or to attempt to conduct re-sale transactions at the Farmers’ Market, may result in termination of my participation in the Downtown Westminster Farmers Market and forfeiture of my registration fee. I will limit any claim I may have against the Mayor and Common Council of Westminster to market fees charged and paid. If I am unsuccessful in any litigation against the City or any Committee member, I agree to pay all costs deriving from litigation, including the market’s attorney’s fees. I further understand and agree that the market management does not warrant, expressly or by implication, that the participants will make a profit. Any false statements I have made on this application will void this agreement and be grounds for dismissal from the market.

  28. RELEASE AND INDEMNIFICATION
    1. In consideration of the permission given to me by The Mayor and Common Council of Westminster (“the City”) and the Downtown Westminster Farmers’ Market Committee (“the Committee”) to participate in the 2026 Downtown Westminster Farmers’ Market, I do hereby expressly waive and release all demands, damages, actions, causes of actions, suits and claims of any nature whatsoever, whether in law or equity, that I or my heirs, next of kin, executors, administrators, estate agents, personal representatives, and assigns, and any other of my representatives might otherwise have against the City, its officers, officials, agents, representatives, employees, contractors, subcontractors, and assigns, the 2026 Downtown Westminster Farmers’ Market, and the Committee, its members, agents and representatives on account of any death or injuries, either to my person and/or to my property, whether foreseeable or not, that may occur, directly or indirectly, or that arise at any time in the future as a result of my activities, association or participation in the 2026 Downtown Westminster Farmers’ Market.
    2. I also expressly agree on behalf of myself and my heirs, next of kin, executors, administrators, personal representatives, estate agents and assigns, and any other of my representatives to indemnify and hold harmless the City, its officers, officials, agents, representatives, employees, contractors, subcontractors and assigns and the Committee and its members, agents and representatives on account of any and all right, claim or cause of actions existing or that possibly could arise at any time in the future as a direct or indirect result of my activities, association or participation in the 2026 Downtown Westminster Farmers’ Market.
    3. I hereby declare that the terms of this RELEASE AND INDEMNIFICATION section have been fully read and understood by me, and freely and voluntarily entered into and accepted by me, and I hereby acknowledge receipt of a copy of this RELEASE AND INDEMNIFICATION section.
    4. I acknowledge that I have had the opportunity to obtain independent legal advice with respect to the execution of this Release and Indemnification section.

  30. RULES AND REGULATIONS GOVERNING THE OPERATION OF THE 2026 DOWNTOWN WESTMINSTER FARMERS' MARKET
    1. The Market shall be known as the 2026 Downtown Westminster Farmers' Market (“Market”) and shall be located on the Conaway North parking lot, adjacent to Maryland Route 27. The governing body of the Market shall be the City of Westminster Community Planning & Development Department (hereinafter, "the Committee"). 
    2. The Market shall be open from 8am until noon on Saturdays. The Market will begin on Saturday, May 16 and end on Saturday, November 21 for a total of 28 market days. It is expected that all full season farmers/producers will attend each Market date. Full time vendors are permitted to miss three markets with advance notice. Part time vendors are expected to attend all markets with all dates being in writing prior to the start of the market season. The Committee reserves the right to refuse any and all farmers/producers, both full and part time, pursuant to the standards in Rule #3.
    3. The use of the Market is restricted to bona fide local farmers, growers or producers of related food items and ornamental horticulture products who have been given permission to participate by the Committee. Every application for participation will be evaluated by the Committee on the basis of demonstrated quality of product, responsibility of the prospective participant, and the quality of his or her prior participation in the Market, among other things. 
    4. Items allowed for sale shall include, but not be limited to meats, fish & poultry, fruits, vegetables, dried and cut flowers, container plants, berries, nuts, eggs, honey, grains, milk and cheese, cider, preserves, baked goods, prepared foods, raw wool and spun wool yarn, hand produced crafts. All produce, defined as mushrooms, vegetables and fruits, offered for sale at the Market must be 100% grown by the farmer/producer, having spent at least 50% of its life on the producer’s land. The re-sale of produce or any product is strictly prohibited.
    5. Sale of all food items is subject to approval by the Carroll County Department of Health. 
    6. For the safety of early customers and respect for other vendors who are set up and ready to sell on time, ALL market participants must:
      1. Text/call the Market Manager if you will be late or not attending.
      2. Arrive by 7:15am (earlier encouraged to allow time to unpack and move vehicle before 7:30)
      3. NO vehicles past road barriers after 7:30am (late? be equipped to carry your gear - think foldable wagon, cart, trolley)
      4. Be in operation by 8:00am (open for business)
      5. Remain in space until the market closes at 12:00pm noon, even if products have sold out prior to closing; use the time to market yourself for next market!
      6. Cleaned up and departed by 1:00pm. 
    7. Violations will result in:
      1. A verbal warning for the first infraction;
      2. Written warning for the second;
      3. $50 fine for the third & subsequent infractions or any ‘No Call No Show’;
      4. Fine must be paid before permitted to set-up next scheduled market date;
      5. Permanent exclusion from the market may be considered for repeat lateness OR no call/text no show on scheduled dates, at the discretion of the Committee.
    8. Market participants are responsible for obtaining any necessary permits required by the State of Maryland, Carroll County, and the City of Westminster for selling their goods. Farmers/producers selling non-edible products that are subject to sales tax must comply with applicable state regulations. A copy of these permits are to be submitted with application when applicable (ex. cottage law health department food license, food truck license, egg law license, etc.)
    9. Market participants agree to make their stands and products offered for sale as attractive as possible. Participants are responsible to provide their own appropriate equipment such as tables, tents, weights. Participants shall keep their market space free from refuse during market hours. Sales shall be conducted in an orderly and businesslike manner. Shouting or other objectionable means of soliciting trade will not be tolerated. No music permitted from vendor spaces other than the booked live market musician for that week.
    10. At the conclusion of market hours, participants shall remove any remaining food items, trash, and associated sales equipment (tables, chairs, baskets, boxes, bags, etc.) from the site as quickly and efficiently as possible.
    11. To cover operating expenses of the Market, the Committee has set a RETURNING FULL TIME VENDOR market fee of $350 and NEW FULL TIME VENDOR market fee of $400 for the first 10’ by 10’ space and $100 for each additional space; a PART TIME VENDOR market fee of $300 for the first 10’ by 10’ space and $75 for each additional space. Other part time options include a Pop Up Vendor market fee of $30 per market for the first 10’ by 10’ space and $75 for each additional space. Food Truck Vendor fee is $30 per market. Extended absences are only permitted with approval of the Committee. Attendance will be noted and participants who miss two or more consecutive weeks or more than four total Market days without approved absences may be asked to leave the Market and may not be invited to return the following year.
    12. The success of the Market relies on the momentum built by the active participation of all farmers/producers, starting with the opening Market day in May and lasting through the last Market day in November. All vendors, unless otherwise excused by the Committee, must participate at the Market on or before the fourth Market day, which is Saturday, June 6, 2026, unless prior notification has been made.
    13. Each full season participant shall have a definite, defined space at the Market location, assigned to it by the Committee. However, the Committee reserves the right to reassign spaces as it sees fit in the best interest of the Market. The size of the space required by the farmer/producer must be listed on the application/agreement that participants sign when submitting their annual fee.
    14. No full or partial season participant shall have the right to sublease, sell, transfer, or permit any other seller to use their assigned space without approval of the Committee.
    15. The City shall select a Market Manager whose duty it will be to assign market spaces, inspect displays, supervise selling practices, collect fees and perform whatever duties are necessary to insure the proper operation of the Market. Market participants must report any accidents or unusual occurrences immediately to the Market Manager.
    16. The Market Manager reserves the right to conduct official on-site inspections of farms or food-producing operations used by Market participants.
    17. Complaints of a suspected violation of the producer-only rule should be submitted in writing to the Market Manager for Committee review. The identity of the person complaining shall be kept confidential. The Committee may notify the subject of the complaint in writing and confer with Market members and others, if necessary, to determine what level of investigation is necessary, up to and including a site visit. Farmers/producers refusing to cooperate with a site visit will be permanently removed from the Market. Any farmer/producer who is found to have violated the producer-only rule will receive a warning, a temporary suspension, or be permanently removed from the Market, depending on the severity of the offense. Any subsequent violation of the producer-only rule will be grounds for permanent removal from the Market. Complaint resolution is the responsibility of the Committee who shall act upon the complaint within two weeks of receipt of the complaint in writing. If violations of the Market Rules & Regulations relating to Producer-Only Violations result in suspension or exclusion from the Downtown Westminster Farmers’ Markets, no refund of fees will be made.
    18. Participants must accept Maryland Department of Agriculture's Farmer's Market Nutrition Program (FMNP) coupons, which will be redeemed by the Maryland Department of Agriculture (where applicable); Carroll County Food Sunday Vouchers (where applicable), redeemed by the Carroll County Food Sunday program.
    19. The Committee does not warrant, expressly or by implication, that the participants will make a profit.
    20. The City and the Committee specifically disclaim any liability or responsibility for the quality of the products of the participants.
    21. Market participants agree not to practice distress pricing at any time during the market season on-site.
    22. All flowers must be locally grown by the farm representing the Market stand. Fresh flowers must be picked within 48 hours.
    23. Fruits and vegetables shall be picked within 48 hours of market day to the greatest degree possible and be of the highest possible quality. Sales of wilted or low-quality goods may result in the termination of the farmer/producer’s participation in the Market.
    24. In addition to food sales, the Market may offer community-oriented workshops, demonstrations, and entertainment at regularly scheduled intervals throughout the season.
    25. The Committee will reserve one sales space in the Market for its own fundraising and promotional activities, such as membership drives and sales promotional items. Use of funds from such sales shall be strictly limited to meeting Market and Committee expenses and are not intended for profit by any individual.
    26. The Committee shall promote the Market through print advertising, press releases, website, posters, and other appropriate means at the start of the season and when appropriate afterwards.
    27. No insurance is provided by the Downtown Westminster Farmers' Market to participants in the Farmers' Market. Market participants must have appropriate liability insurance with coverage limits of at least $500,000 per occurrence; a copy of the participant’s insurance certificate must be submitted with this application/agreement which lists the Downtown Westminster Farmers Market as additional insured.
    28. The Committee has the responsibility and authority to direct farmers/producers to comply with the Downtown Westminster Farmers’ Market Rules & Regulations. Complaints regarding violation of rules, other than the Producer-Only Violations, may be referred verbally or in writing to The Committee for resolution. First offense – verbal warning. Second offense – written warning. Third offense – temporary suspension (1-4 weeks). Fourth offense – permanent expulsion. If violations of the Market Rules & Regulations or other rules result in suspension or exclusion from the Downtown Westminster Farmers’ Market, no refund of fees will be made.
    29. All participants in the Market agree to abide by the foregoing rules and regulations. The Committee shall be responsible for enforcing the above Rules and Regulations; and reserves the right to revise the Rules and Regulations at any time as deemed appropriate. Participants will be notified, in writing, of any changes to the Rules and Regulations. The Downtown Westminster Farmers' Market reserves the right to cancel the approval of any vendor's application/agreement if and when the Downtown Westminster Farmers' Market finds said farmer/producer in violation of any of the aforementioned rules and eligibility requirements.
